What is the ARC Europe debt collection process?

The process of debt collection begins with creditors (companies) sending out a letter notifying the person(s) that they owe them money and advising them how much is owed. These letters are legally binding on the person named- if you don’t think you owe it, or somebody has used another name to commit fraud and gets sent a letter, then get in touch with the Collection Agency as soon as possible.

If bills are unpaid, there comes a point where creditors will attempt to recover what is owed by taking legal action against individual consumers.

The financial conduct authority says there should be three clear steps in the collection process:

  1. Sending an initial letter giving details of their failed payments
  2. The second letter shortly afterwards warning that they risk being taken to court and explaining how this could happen
  3. A final letter to leave a final chance for money to be paid before taking legal action

Debt collectors usually work with law firms, and so they will typically refer your case to a solicitor who will review all your financial documents before taking you to court for any kind of claim. In the United Kingdom, as in many jurisdictions, a person may be taken to court for seeking to collect money from someone for unpaid debt. Specifically, people are usually taken to court if they make the process of pursuing debt too difficult (such as making threats or failing to deliver paperwork) or if they pursue debts that cannot legally be pursued because either it has nothing owed on it and/or the statutory limitation has elapsed. In recent years there have been various amendments made by Parliament which grant more rights to consumers who know their rights and seek enforcement through means such as requests for a letter of demand.

How do I know if ARC Europe Ltd is legit?

ARC Europe are a debt collection agency authorised and regulated by the Financial Conduct Authority (Reference No. 716072) for accounts formed under the Consumer Credit Act 1974 (amended 2006).

What does the Financial Conduct Authority do?

The Financial Conduct Authority is essentially the watchdog of financial institutions in the United Kingdom. It does not regulate on a formal basis, but when disputes arise about any contracts dealing with finances it has an indirect say through its powers to enforce market regulations. The FCA has been heavily criticised for their culture of deliberate laxity since they were created after the 2008 Global Financial Crisis to promote more stringent regulation and consumer protection that caused it to lose public trust. In 2012, a British parliamentary committee recommended that Parliament should consider abolishing the FCA altogether because “it risks undermining investor confidence further by sending too mixed signals about its willingness to enforce high standards.”

How to negotiate with debt collection companies like ARC Europe

Often times creditors like ARC Europe will negotiate with a delinquent debtor before legal action can be taken.

What would you do if a debt collector called to tell you that they’re sending your account over for collection?

The first thing is usually panic. What does this mean, exactly? Are my wages going to be garnished or will I get sued by them in court and have all of my assets seized? In order to determine the right course of action from here on out with such an aggressive creditor like ARC Europe’s collections department, we can’t just look at what other people might recommend – it’ll depend largely on how much money we owe them versus our total income ratio (that means anything above 30%!).
