So, lets find out more about how ARC Europe work …
Should I ignore the ARC Europe debt collectors?
This answer depends on a few different factors, but in general, ignoring debt collection agencies like ARC Europe will not make them go away.
What type of debt is ARC Europe chasing?Student loan, medical bill or something else? The UK limits how much debt collectors can share about your debt with you.
Does ARC Europe have a valid “statutory demand” for payment and what are its terms? They must provide a complete account of all outstanding charges with their letter if they want to start legal proceedings to recover them, including an example of the calculations that will be used in any court enforcement process. Once this is provided, it’s possible to make an informed decision about paying or ignoring the demand/letter. If you need help or advice, give us a call to discuss your options today!
What is the ARC Europe debt collection process?
The process of debt collection begins with creditors (companies) sending out a letter notifying the person(s) that they owe them money and advising them how much is owed. These letters are legally binding on the person named- if you don’t think you owe it, or somebody has used another name to commit fraud and gets sent a letter, then get in touch with the Collection Agency as soon as possible.
If bills are unpaid, there comes a point where creditors will attempt to recover what is owed by taking legal action against individual consumers.
The financial conduct authority says there should be three clear steps in the collection process:
- Sending an initial letter giving details of their failed payments
- The second letter shortly afterwards warning that they risk being taken to court and explaining how this could happen
- A final letter to leave a final chance for money to be paid before taking legal action
In essence, a creditor like ARC Europe limited initiates the debt recovery process by sending a letter to you demanding repayment of a debt that is not disputed or is agreed upon and under dispute.
If you have said that you will pay them then they will give your instructions on how much money should be transferred into their account by stating the date this has to happen and what time it should take place.
Will ARC Europe debt collectors come to my house to collect this debt?
The law of debt recovery in the UK is governed by statute, principally by the Insolvency Act 1986, the Companies Act 2006, the Consumer Credit Act 1974 and Regulations made under those acts.
ARC Europe limited may come to your house to collect your debts, but this is not their typical first moveEmployees of a company trying to collect debts that are owed on an account are usually professionals, authorised by the company for this purpose. Debt collectors are more than happy to contact people who owe money and often make them some sort of offer which allows people who haven’t any actual income left to still be able to either live or carry on their daily activities with less disruption caused by their debt situation. ARC Europe Ltd Debt Collection might have designated field agents to visit homes to discuss the alleged debt. These visits can be extremely distressing for you but also for your entire family.
Home visits are one of the many ways that ARC Europe Ltd Debt Collection uses to reach out to people who owe money.Debt collectors do not need to have a court order before coming to your house. They will often visit your house if they have had no contact with you (or it’s been over one year) and are trying to locate you for repayment of the debt. In these instances, you can ignore them. Most debt collectors will assume that you’re not home even if you clearly are inside the house because they don’t want you to feel like they’re breaking into your private space. So yes, they will come knocking on your door. This could continue if you don’t appoint a debt company to deal with them on your behalf. We are a well-established debt website that has had a lot of experience dealing with creditors like ARC Europe Ltd Debt collection. We are familiar with the tactics they use and can help you stop them.
How will ARC Europe Ltd Debt Collection chase me if I don’t pay?
Creditors such as ARC Europe Ltd Debt Collection often use computer systems to keep on top of their debtors. They typically follow a clear process that they believe will make them the most profit; these methods are seen by many as being aggressive and you may have heard documentaries or read articles criticizing how heavy-handed they can be, but this has been significantly reduced with changes in the law brought about by governmental organisations.
The main tactic employed by ARC Europe is still intimidation: making people feel intimidated into paying what is owed quickly. The first point of contact which ARC Europe Ltd Debt Collection may use will be an introductory phone call and letter. This is to set out their pre-action protocol. You will usually receive (in writing) a letter explaining the total amount of debt owed, any charges/penalties which may have been accrued and a tight deadline for you to repay in full or face further consequences if not paid by said date.
These debt recovery steps taken by ARC EUrope are usually:
- A home visit
- A county court judgement (CCJ), issued by ARC Europe Ltd Debt Collection if you fail to repay the debt within this tight deadline
- A threat of bankruptcy (usually if the debt is over £750)
Please be aware that it is very common for debt collectors to use tactics like this in order to scare you into paying up. You can get help from us if you call now – but please act quickly before the situation becomes too serious.
Does ARC Europe take you to court?
It is not very likely that debt collectors would take you to court in the U.K. Most of the U.K.’s debt recovery system is governed by a statute called The Insolvency Act 1986.
Many people are under the mistaken impression that debt collectors in the UK automatically take you to court. In fact, most debt recovery agencies don’t even mention court orders on their websites as part of their protocols. However, county court judgments are typically where things end up.
There’s an intimidation factor that goes along with being taken to court (which is often used by bailiffs).Debt collectors usually work with law firms, and so they will typically refer your case to a solicitor who will review all your financial documents before taking you to court for any kind of claim. In the United Kingdom, as in many jurisdictions, a person may be taken to court for seeking to collect money from someone for unpaid debt. Specifically, people are usually taken to court if they make the process of pursuing debt too difficult (such as making threats or failing to deliver paperwork) or if they pursue debts that cannot legally be pursued because either it has nothing owed on it and/or the statutory limitation has elapsed. In recent years there have been various amendments made by Parliament which grant more rights to consumers who know their rights and seek enforcement through means such as requests for a letter of demand.

How to negotiate with debt collection companies like ARC Europe
Often times creditors like ARC Europe will negotiate with a delinquent debtor before legal action can be taken.
What would you do if a debt collector called to tell you that they’re sending your account over for collection? The first thing is usually panic. What does this mean, exactly? Are my wages going to be garnished or will I get sued by them in court and have all of my assets seized? In order to determine the right course of action from here on out with such an aggressive creditor like ARC Europe’s collections department, we can’t just look at what other people might recommend – it’ll depend largely on how much money we owe them versus our total income ratio (that means anything above 30%!).
The first thing to do is to check that you actually owe ARC Europe money.
It’s possible they are calling about someone else that has your phone number.
You can Google the creditor and find their website with a little sleuthing, and also try using the contact information on any letters sent by them in order to reach them through an alternate number.
Start negotiations early, as soon as you get contact information from them; don’t wait for anything more than a letter before responding with your question about what debt they’re talking about and why exactly it is owed, sending copies of letters back-and-forth if necessary.
Even if you owe money, be polite but firm in asking for confirmation of this so that you have all the facts in front of you.
